Defense wants Jonril Bacalso to testify for ex-cop Durano By Grecar Nilles
AS IF presenting Jonril Bacalso in former policeman Engilberto Durano’s murder case was not enough, the defense plans to use Bacalso in another case.
Defense lawyer Salvador Solima said they will tap Bacalso to clear Durano’s name in the foiled attempt on the life of witness Lloyd Carampatan in March 2001.
Bacalso is the 18-year-old son of tricycle driver Rogelio, who was gunned down in Gardenville Subdivision in Busay, Cebu City on Dec.22, 2000.
Durano is charged with murder for allegedly killing Rogelio and with frustrated murder for allegedly being behind the move to kill Carampatan, a key witness in the Bacalso case.
Solima, who believes that the evidence of the prosecution on the frustrated murder case is weak, said he will file a demurrer to evidence.
If the court denies the demurrer to evidence, which Solima plans to file when the prosecution rests its case, he would call Jonril to the witness stand to rebut Caram-patan’s claim.
A demurrer to evidence is an application to dismiss a case. It is an aid or instrument for the immediate termination of an action or a case, which the court may either grant or deny.
“He is a vital witness to the frustrated murder case because he was around when the incident happened. He will prove that Durano has nothing to do with the attempt on Carampatan’s life,” Solima said.
Bacalso and Carampatan were together in going to the Cebu Business Park when Carampatan was shot in the head. Roy Pineda was blamed for the attack.
Carampatan, who is the prosecution’s star witness in Durano’s murder case, survived the attempt on his life.
Carampatan had testified in court that he saw Durano inside a car laughing before he fell to the ground after he was shot in the head.
Solima also confirmed that Jonril is no longer staying with his new family.
“Jonril told us that he is staying with his friends. He also said that some of his relatives are helping him out in his daily needs,” Solima said.
Jonril earlier testified in court that Durano has nothing to do with the killing of his (Jonril’s) father, which angered his (Jonril’s) relatives and friends.
