A TEENAGER’S father accused five boys, including a 14-year-old and a 17-year-old, of stabbing his son to death using a knife and a broken bottle.
The two minors, however, were excluded in the criminal charge of murder approved by Prosecutor William Canta, who said there was “no clear indication” of their involvement in the crime.
Eighteen-year-old Leonilo “Eloy” Trazona died at dawn last Jan. 27 after a night out with his friends Orly Villamor and Arnel Cabuylog.
Villamor, an 18-year-old fashion accessory worker, said their group went to a disco in Barangay San Roque, Talisay City at 2:30 a.m. on Jan. 27.
From the time they entered the disco until they left, Villamor said they noticed a group of four men frequently looking their way and observing them.
At nearly 4:00 a.m., the three friends left the disco bar. Villamor said they then saw “six youngsters,” whom he identified in his affidavit as Marlon Ybañez, Junreal Lariosa, a certain “JR” and someone nicknamed “Roslie,” who was also called “Bosing” by some.
Villamor also named the two minors.
He said the six boys were members of the Black Rosary Gang.
He narrated that the six boys suddenly approached Eloy and stabbed him “several times” with a knife, until Eloy was sprawled on the ground.
Ybañez reportedly finished the killing by stabbing Eloy repeatedly with a broken bottle.
‘He’s dead’
With Eloy lying and bleeding on the ground, one of the suspects shouted in vernacular, “Let’s go! He’s dead!”
Villamor said that while he and Cabuylog had wanted to help Eloy, they feared the suspects, who were carrying bladed weapons.
Eloy was proclaimed dead on arrival when his friends brought him to the hospital.
However, the two minors, Raymund and Edward (real names withheld), executed separate counter-affidavits denying the accusation.
Raymund, 14 at the time of the crime, said he was with Edward at the same disco bar in Barangay San Roque from 9:00 p.m. on Jan. 26 until 3:30 a.m. the next day.
He said that as they were walking home, they saw the commotion and fled from the place.
Edward gave the same defense. While admitting that he and Raymund were with Ybañez’s group from the disco, Edward denied any participation in the crime.
Edward said he and Raymund immediately ran away to avoid involvement. He added that he “never knew the group was envious of the victim.”
In his affidavit, Raymund called the accusation “a falsehood and a blatant lie.”
Edward echoed his friend’s sentiments.
Dream
“My only dream is to finish my studies and help my poor parents. I have no ambition to become a toughie in our neighborhood or become a killer,” Edward said in his affidavit.
A clarificatory hearing was held among Eloy’s father Feliciano, Villamor and the two minors.
In a two-page resolution, Canta said that with respect to Raymund and Edward, “aside from their minority, which exempts them from criminal liability, there was no clear indication that they were involved in the slaying of the said victim.”
Canta approved yesterday the filing of a criminal charge of murder against Ybañez and Lariosa.
While finding out that “JR”, “Roslie” and “Bosing” were nicknames of only one person, the criminal information read that this person “will be prosecuted separately as soon as he is identified.”
Though murder is a non-bailable crime, the three suspects remain at large. (KAB)
